AWESOME POSSUM PHOTOGRAPHY - Terms and Conditions
These terms and conditions govern your use of AWESOME POSSUM PHOTOGRAPHY services and website www.awesomepossumphotography.com By accessing or using our services or Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or Site.
1. Services
We offer various photography services, including but not limited to Newborn Photography, Maternity Photography, Milestone Photography, Cakesmash Photography, Family Photography, Event Photography, Portrait & Mini Sessions, Corporate Shoots, Headshots and Photo Editing. The specifics of each service will be detailed in individual contracts.
2. Booking and Payment
2.1 Booking: To book a photography session, you must contact us through our Site, email, or phone. A non-refundable deposit may be required to secure your booking.
Payment: Full payment is due a day before your session unless otherwise specified in the contract. We accept electronic transfers as a payment method.
2.2 Cancellation Policy: If you need to cancel or reschedule, please notify us at least 5 days in advance. Cancellations made within 48 hrs of the scheduled session may be subject to a cancellation fee or based on your contract the fees will be charged.
3. Copyright and Usage Rights
3.1 Copyright: We retain the copyright to all images captured during the photography session.
3.2 Usage Rights: Clients are granted a non-exclusive, non-transferable license to use the images for personal or business purposes as outlined in the contract. Any commercial use must be explicitly agreed upon in writing.
3.2 Restrictions: Clients may not sell, license, or otherwise distribute the images without our prior written consent.
4. Client Responsibilities
4.1 Cooperation: Clients must cooperate fully during the photography session to ensure the best possible results. This includes arriving on time and providing any necessary information or assistance.
4.2 Permissions: Clients are responsible for obtaining any necessary permissions, including property releases and permits, for the locations where the photography session will take place. We do Not Allow Any Photography or Videography from CLIENT's Personal Devices during the session.
5. Deliverables
5.1 Image Delivery: Final edited images will be delivered within 3-5 weeks of the photography session, unless otherwise specified in the contract or agreed after the selection gallery.
5.2 Format: Images will be delivered in a digital format with standard size and resolution. If you have any specific requirements for the size, resolution, or format of the images, these must be mentioned and agreed upon before the photography session or before paying the deposit. Prints and other physical products can be ordered for an additional fee depending on the selection of package or agreed in the contract.
6. Limitation of Liability
6.1 Image Storage and Responsibility
6.1.1 Storage Duration: We will store the final images for three (3) months (or up to the Time specified in the Contract Otherwise) after delivering the final images to the client. After this period, the images will be permanently deleted from our storage systems.
6.1.2 Client Responsibility: It is the client's responsibility to download and securely store the final images within the provided timeframe. We are not responsible for clients who fail to download the images in a timely manner.
6.1..3 Limitation of Liability: We do not hold accountability for the loss of images once the final delivery has been made. Clients are encouraged to create backups of their images to prevent any potential loss.
6.2 No Guarantees: While we strive to provide the highest quality services, we cannot guarantee specific results. The final outcome of the images may vary based on numerous factors, including lighting, weather, and client/kids' cooperation.
6.3 Liability: Our liability for any claim arising out of this agreement is limited to the amount paid by the client for the services. We are not liable for any indirect, incidental, or consequential damages.

7. Privacy
We are committed to protecting your privacy. Please review our Privacy Policy Privacy Policy for information on how we collect, use, and safeguard your information.
8. Amendments
We may update these Terms from time to time. Any changes will be posted on our Site with an updated effective date. Continued use of our services or Site after any such changes constitutes your acceptance of the new Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of [Victoria/Australia]. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of [Victoria/Australia].
10. Booking Fees and Contract Agreement
By paying the booking fee, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in the contract. Your payment confirms your acceptance of the contract, and we will proceed with the booking based on this agreement.
